1. Introduction

Welcome to ExChange ("Service"), operated by ExChange, Inc. ("we," "us," or "our") at tryexchange.io. By accessing or using our Service, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms").

2. Service Description

ExChange provides a professional mediation service that coordinates the exchange of belongings between former partners. Our ExChangers handle communication and logistics to minimize stress and awkward interactions during the property exchange process.

3. Scope of Service

Our service includes:

• Professional mediation between former partners
• Coordination of communication regarding property exchange
• Assistance with planning the logistics of exchanges
• Documentation of exchange efforts

Our service does not include:

• Shipping, logistics, or transportation costs
• Insurance for items being exchanged
• Exchange of illegal items or substances
• Guarantees regarding third-party transport/delivery services

4. User Responsibilities

You agree to:

• Provide accurate and truthful information about yourself and the items to be exchanged
• Respond to communications from your assigned ExChanger in a timely manner
• Pay all applicable fees before service commences
• Handle all shipping, logistics, or transportation costs as needed
• Not request the exchange of illegal items or substances

5. Fees and Payment

The current fee for hiring an ExChanger is $20. This one-time fee includes all communication and coordination between both parties to facilitate the exchange of property. Additional services may incur additional fees, which will be clearly communicated before any charges are applied.

6. Service Timeline

The typical exchange process takes 5-7 days, depending on the complexity of items and responsiveness of both parties. ExChange does not guarantee completion within any specific timeframe.

7. Cancellation and Refunds

We reserve the right to discontinue service at any time for any reason without providing a refund. This includes, but is not limited to, situations involving abuse of our service, violation of these Terms, or illegal activity.

8. Limitation of Liability

To the maximum extent permitted by law, ExChange, Inc. and its officers, employees, agents, affiliates, and partners shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss, damage, or deterioration of items during the exchange process
• Actions or inactions of third-party delivery or transportation services
• Failure to complete an exchange due to uncooperative parties
• Any disputes regarding ownership of exchanged items
• Any claims exceeding the amount paid for our services

9. No Guarantees

While we strive to facilitate successful exchanges, we cannot guarantee that all exchanges will be completed successfully. If an ex-partner refuses to cooperate after several documented attempts, we will provide documentation of our efforts and suggest alternative solutions.

10. Confidentiality and Privacy

We take privacy seriously. All personal information and exchange details are kept strictly confidential and are only shared with the assigned ExChanger handling your case. Please refer to our Privacy Policy for more details on how we collect, use, and protect your information.

11. Service Area

We currently operate in the continental United States only. Service availability may vary by location.

12. Indemnification

You agree to indemnify, defend, and hold harmless ExChange, Inc. and its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from your use of our Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of our Service following any modification constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Jersey, without regard to its conflict of law provisions.
